The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with White Palm Garden GbR hereinafter referred to as “whitepalmgarden.com”, "us" or ”we”, at the White Palm Garden website, mobile website or mobile application.

By using whitepalmgarden.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

 

The inclusion of any products or services on whitepalmgarden.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on whitepalmgarden.com at the time you place your order.

 

1. DELIVERY, COSTS, TIMES, PRICES

 

Delivery will be handled in cooperation with DHL or other well-known forwarders.

White Palm Garden will send the ordered goods to the stated address by customer.

Shipping’s to Germany are free of charge.

For all shipments the purchaser will take delivery cost flat rate.

Purchases outside of the EU may be subject to import charges and taxes. White Palm Garden accepts no responsibility for these charges. Please check with your local customs office before ordering if you are unsure as to whether this may apply to your country.

United Staats, Canada: 20,00 EUR

Australia, New Zealand: 20,00 EUR

 

For delivery to any other destination not listed here above, please kindly contact us per email (info@whitepalmgarden.com). We will calculate the shipping costs for you in advance and inform you accordingly.

 

DELIVERY TIMES:

Germany:  2-5 working days

All other destinations: 5-10 working days (depending on forwarder)

 

Due to the size of the box we are not able to ship to German “DHL Packstationen”.

Picking up your ordered merchandise in a store is not possible.

 

The prices displayed at whitepalmgarden.com include the statutory Value Added Tax but do not include a delivery charge.

If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries.

 

SHIPMENT CONDITIONS:

Shipment is only possible with parcel-service. We sell our products in reasonable amounts only.

Orders will be shipped from the warehouse to the provided delivery address. You will find information about availability for each item. Please kindly note that all information about availability, shipping and delivery for each item are only approximate data. This information is not binding or guaranteed. If we notice that your ordered items are out of stock we will inform you by email immediately.

 

ORDER TRACKING:

As soon as your parcel is on the way we will inform you by email with the tracking number. You can check the status of your shipping within a few hours within the link.

 

2. ORDERING (CONCLUSION OF CONTRACT)

 

The ordering options available to you are via whitepalmgarden.com.

Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, White Palm Garden customer service will contact you to settle the refund.

 

3. WITHDRAWAL OF ORDER 

 

You may cancel or return your order from the date you place the order until 14 days after receipt of the ordered items. If you have been charged for the items, you will receive a refund which will include White Palm Garden standard delivery costs. Should you choose to keep certain items and only partially cancel your order, the delivery cost will not be refunded. You will find the full Return Policy at section RETURNS / REFUND.

 

If you wish to cancel or return your order, please provide us with notice in writing either by post or by sending a letter to:

and return the item(s) to us as set out in section RETURNS / REFUND below within the 14 day period.

If you wish to cancel or return your order you have to bear the costs of shipping to White Palm Garden.  

 

We will provide a refund attempting to use the same method used to make the payment as soon as possible and at the latest within 14 days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the items. Another payment method may be used for the refund, provided that you consent to such change; in any case this will not generate any additional charges.

 

4. RETURNS, REFUND, CANCELLATION, CLAIM 

 

Was the product different than you expected? Here you will find information on how to proceed when you have sent back your order or wish to cancel or make an exchange. Keep in mind you have 14 days to decide if you want to return your product(s), beginning from the time you receive your package.

If you wish to return one or more articles and you are based within Germany shipping is free of charge. After you have send an email to us we will provide a postage stamp to you. Free shipment is only possible with provided postage stamp.  

If you wish to return one or more articles and you are not based in Germany you have to bear the costs of shipping. 

Remember it is you, the customer, who is responsible for the return until we have received and registered it, so always save your deposit slip. It take up to 14 days for a return to come to us.

 

Please kindly note that we can only except returns/cancellations under following conditions:

-       the articles are in proper conditions

-       label and hangtag are not removed

-       articles are not dirtied and not washed

-       articles are complete

-       articles are not used

If you wish to return one or more articles and you are based within Germany shipping is free of charge. After you have send an email to us we will provide a postage stamp to you. Free shipment is only possible with provided postage stamp.  

If you wish to return one or more articles and you are not based in Germany you have to bear the costs of shipping. 

 

REFUND:

When you have received a return confirmation by email, the process for your refund is initiated.

PayPal: 1-5 working days. The refund will be transferred to the same PayPal-account used for payment.

Debit and Credit Cards: 1-5 working days. The refund will be transferred to the card used for payment. 

Please keep in mind it can sometimes take up to 14 days between return and refund.

 

CLAIM:

If you receive a faulty or incorrect item, we are very sorry for that and will take care of this immediately.

Please contact us at info@whitepalmgarden.com with a short description and may add a few images describing the fault and await further instruction before returning the item(s). Our customer service team will inform you about the next steps.

 

5. PAYMENT METHODS 

 

Following payment terms are possible at whitepalmgarden.com:

 

PAYPAL (credit card, debit card, credit transfer)

You can pay the invoice amount secure and fast via PayPal. Therefore you will be forwarded to PayPal website while completing your order. If you already have a PayPal account you just log in with your data and complete the payment. If you might not have a PayPal account yet, you are able to log in as a guest and complete the payment. More information will be provided during ordering.

 

 

6. LIABILITY 

 

White Palm Garden is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity. Our maximum liability to you for any loss or damage arising in connection with your order on whitepalmgarden.com shall be limited to the total price of your order.

 

If you have a problem with a product that you have purchased from whitepalmgarden.com, and were not able to settle the complaint with White Palm Garden, then you can submit your complaint to the EU’s online dispute resolution platform (the “ODR platform”).

The ODR platform offers consumers and traders within the EU with the possibility to try and reach an out-of-court settlement for complaints arising from online purchases. We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

 

7. ASSIGNMENT 

 


White Palm Garden reserves the right to assign or pledge to third parties any claim(s) for payment including any payment instalments which have arisen in connection with the delivery of goods.

 

8. SEVERANCE


If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

 

9. OWNERSHIP OF RIGHTS 

 

All intellectual property rights, such as trademarks and copyrights at whitepalmgarden.com remain with White Palm Garden and its subsidiaries or licensors. Any use of whitepalmgarden.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of White Palm Garden.

 

10. PRIVACY POLICY

 

White Palm Garden GbR will collect personal data that you submit to us, for example, when you place orders, contact our customer service or participate in competitions. The personal data that you submit to us may for example include contact information, date of birth and payment information. In addition we may collect certain personal data from external sources such as credit information and address updates.
